Welcome to NITS Tech Systems Learning Management System (the "Platform"). By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

• Copy, reproduce, or distribute Platform content without permission
• Create derivative works based on Platform content
• Remove copyright or proprietary notices
• Use Platform content for commercial purposes

5.2 User Content

By submitting content to the Platform, you:

• Warrant that you have the right to submit the content

8.2 Termination by NITS Tech Systems

8.3 Effects of Termination

Upon termination:

• Your right to use the Platform ceases immediately
• You must cease all use of the Platform

• Academic records may be retained as required

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Educational outcomes are not guaranteed and depend on individual effort and circumstances.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NITS TECH SYSTEMS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Personal injury or property damage
• Actions of other users or third parties

Our total liability for any claims arising from these Terms shall not exceed the amount paid by you to us in the past six months.

You agree to indemnify, defend, and hold harmless NITS Tech Systems, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your infringement of any intellectual property rights
• Your conduct towards other users
• Any content you submit to the Platform

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes shall be resolved as follows:

1. Negotiation: Parties shall attempt to resolve disputes through good faith negotiation
2. Mediation: If negotiation fails, parties shall attempt mediation with a neutral third party
3. Arbitration: If mediation fails, disputes shall be settled by binding arbitration in Johannesburg
4. Court Proceedings: Either party may seek injunctive relief in court

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions or consolidated claims.

We reserve the right to modify these Terms at any time. We will notify you of changes by:

• Posting the updated Terms on this page
• Sending email notifications to registered users
• Displaying notices on the Platform

Your continued use of the Platform after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Platform.
